-Terms of Service-

By commissioning me, you are confirming to have read and agreed to these Terms of Service.
If you fail to comply with any of the terms stated, I have the right to decline your order.

I. General

  1. If you are rude or have poor manners, I hold all the rights to decline your commission request.

  2. When placing a commission, please be as clear as possible.

  3. I will NEVER resell/repurpose commission pieces through Non-Fungible Tokens (NFT), trade them for Cryptocurrency or include it in Blockchain media.

  4. I will not do NSFW/Gore/18+ commissions if you are a minor. By requesting this type of commission, you are confirming to be 18 or older.

II. Payment and Refund Policy

  1. All payments must be via Paypal and in EUR.

  2. You can choose from 2 payment plans:

  • Plan A: Half-Half. You pay half of the total upfront and the final half right before I send you the finalized project.

  • Plan B: Full Upfront. You are to pay the total price before I start your commission.

  • Note that if any changes that need to be charged are requested along the way, you will pay that added rate before I send you the final piece.

  1. I will NOT accept any cryptocurrency payment.

  2. Never send the payment on your own. You will be notified when the invoice is sent to you. I will notify you the moment the payment is received. I will also notify you when I send the final project, and you will be required to confirm to me that you have received it.

  3. I will only start the commission once Plan A or Plan B of payments have been received.

  4. Full refunds are no longer accepted after I have begun the commission, only partial refunds are acceptable and may be negotiated.

  5. I am entitled to cancel a commission and refund (if paid for) if the commissioner is being extremely rude or otherwise unpleasant in an unbearable manner.

⁕ Refunds Will Be Allowed If:

  • For some reason, I am forced to cancel your commission due to unforeseen circumstances, and if you have already paid/I have not started the commission, you will receive a full refund.

  • If you are still not satisfied with the direction the commission is going, and you do not wish to continue the commission.

  • If partial payment has been made, and in an unforeseen circumstance, you are unable to pay the remaining portion and are forced to cancel the commission.

  • If for some reason, I am unable to finish the commission in a reasonable amount of time and need to majorly delay working, or cancel the piece.

III. Ordering

  1. In general, commissions are in a "first-come, first-go" basis, based on who pays first. If two or more clients make a request at the same time, I will prioritize by order of who pays first. For example, if client #1 contacts me, and is still in the communication phase, and client #2 has contacted me and paid already, I will put client #2 first on the list.

  2. If you have a timeline in mind, please make sure to mention that right away. By having a specific date to have the commission finished, whereas other clients won't have any deadline requested, you will be put at the top of the list.

  3. The client is always required to provide as much information and description as possible:

  • Please make sure to send photos and images of good quality and well-lit, so I can use them as accurate references.

  • If the commission request is to draw something from real life, the client is required to provide reference images.

  • If you have, send images showing a 360 view of your character/subject matter preferred (front, back, both sides, etc.)

  • When sending photos, provide a short, written description of key features of your request that may not be obvious in the reference images. For example, if the request is for a dog picture, helpful info could include breed, color, personality, age, etc….

  • Provide sentences describing physical details such as colors, markings, scars, accessories, powers, etc...

  • Also include key personality traits such as girly, mischievous, angsty, emo, etc. (A reason for the traits is not necessary)

IV. Process

  1. Any commission will have a maximum time span of 30 days. This is to prevent any casualties that may come in the way of continuing the commission such as:

  • My own schedule

  • Any life, personal or health reasons

  • Technical difficulties or malfunctions

  • More than 1 commission being in the works

  • etc...

  1. I will always notify you if I know there will be a delay in the commission work.

  2. If you have any deadline for your request, you must inform me about it immediately.

  3. Special themed requests, such as Holiday drawings, Birthday drawings, etc, will need to be requested in advance so they can be delivered to you on the wished date (ex: requesting ahead of time for a Christmas drawing, so that you can receive it on the 24th or 25th).

  4. I will provide screenshots of the process in order to both prove I'm working on the commission, and also check with the client if there is any change needed to be done. I will also send a low-quality image of the finalized drawing, in order to confirm there is no mistake. Once the final revision has been done, I will send you the full-quality image.

  5. You CAN add input or changes to the sketch phase, in order to choose the best poses or fix some key elements of the drawing (ex: hair length, body shape, etc) or in the color phase, in order for me to color accurately your commission (ex: skin tone, hair color, eye color, birthmark locations, etc).

  6. Any bigger changes will have to be charged, starting from 10€. NOTE: big changes at the final revision stage will not be done. If it is something that needs to be changed for accuracy, then it'll be charged, but it will have to be discussed first.

V. Rights and Use Policy

  1. The finished art remains the property of the artist, I still retain the full rights to the products itself, as it is a digital item and not a tangible one. The client does not have the right to trace, change, recolor, alter, sell or resell prints or reproductions of the piece in anyway without expressed permission from the artist.

  2. You only purchase the rights to use, share, and display the work (with credit to myself), but you cannot make a profit off of the piece in anyway.

  3. Unless discussed beforehand I, the artist, hold every right to my work, not the commissioner.

  4. Unless requested by the client beforehand to not share it, I'm allowed to use the copyrighted material to promote myself and/or my work and display anywhere to my liking.

  5. If my work is to be used for commercial use, please mention it when placing your order so we can discuss each party's right and the pricings.

  6. Drawings made by me may not, under any circumstances, become associated with hate groups and/or other extremist groups. If I find that a commission has become associated with one of these in one way or another, your right to use the design will be revoked and you will be blacklisted.

⁕ The Client Is Allowed To:

  • Make head-shots or avatars with the work as long as the watermark/copyright is shown or proper credit is given to the artist.

  • Resize or crop the artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but the client cannot alter the artwork itself.

  • Re-upload my work if discussed beforehand and fully credited with a link and username.

  • Print my work.

  • Claim the right of its design but not of the artwork itself.

⁕ Once Agreeing For My Work To Be Commercially Used:

  1. You may use my work for any merchandise, books, covers, props, or any other item you wish to use my artwork on.

  2. You may NOT use my work for anything connected to Non-Fungible Tokens (NFT), Cryptocurrency, or ANY Blockchain media. It will never be allowed.

  3. Credit may still be required, discussed while debating rates and agreements for my work to be commercially used.

⁕ The Following Is Copyright Infringement:

  1. Reproducing/using copyrighted material commercially (as in making money from my work in any way) without first discussing it with me.*

  2. Taking credit for my work, omitting my signature and credit, or removing watermarks/signatures.*

  3. Altering my work without my permission.*

  4. Reselling my work through Non-Fungible Token (NFT), Cryptocurrency, or including it in any Blockchain media.*

*If I come to find out any of these have been done, you will be requested to remove my piece from all places, and you will be blacklisted.

VI. Privacy Policy

  1. I will NEVER at any time, share or sell your personal information, such as your full name, address, PayPal, etc to another user on any other site on the internet (unless you specifically request it). Information is otherwise treated with strict confidentiality.

  2. If you wish to remain anonymous as the commissioner, let me know as well, and I will be sure not to add any identifiable information to the piece, nor tag you, when uploading it to an online gallery.

  3. If you wish for the piece to NOT be uploaded for some reason, please let me know as well.

If after reading my Terms of Service, you are still unsure about something or have any questions, please do not hesitate in asking me.
I will always make sure you have read the Terms of Service by asking you some questions about it.
